Terms of use

These terms cover your use of the DayTone app and its song service. They are written to be read, so please do.

The agreement

DayTone is made by PantaWorks LLC, a DBA of Munchy Snacks (“PantaWorks”, “we”, “us”). By downloading or using DayTone you agree to these terms and to our privacy policy. If you don’t agree, please don’t use the app.

DayTone is distributed through Apple’s App Store, so Apple’s standard end user licence agreement also applies. Where the two differ, these terms apply between you and us. Apple is not responsible for DayTone or its support.

You need to be at least 13 years old to use DayTone.

What DayTone does

DayTone is an alarm clock. Ahead of an alarm, it can write a short original song around the goals, personality and genre you choose, and it keeps a built-in backup sound ready so the alarm rings either way. You can use it without creating an account.

Making a new song needs an internet connection and our servers. We may change, improve or retire features over time.

Plans and subscriptions

  • Free: classic-sound alarms, plus a limited number of new songs, as shown in the app.
  • DayTone Plus: a paid subscription with more songs and features, as described in the app at the time you subscribe. It is offered monthly (US$4.99 a month) or yearly (US$39.99 a year, with a 7-day free trial for new subscribers). Prices in other countries are set in local currency and shown in the app before you buy; taxes may apply.
  • Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends.
  • Auto-renewal: your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
  • Free trials: a trial becomes a paid subscription when it ends unless you cancel at least 24 hours before. Trials are for new subscribers, one per Apple ID. Any unused part of a trial is forfeited when you buy a subscription.
  • Cancelling: manage or cancel in your iPhone’s Settings › your name › Subscriptions. Cancelling stops the next renewal; you keep Plus until the end of the period you’ve paid for. Deleting the app or your DayTone account doesn’t cancel a subscription.
  • Price changes: if the price of Plus changes, Apple tells you before it applies, and where the law requires, asks you to agree first. If you don’t want to pay the new price, cancel before your next renewal.
  • Refunds: payments are handled by Apple under its policies, so ask Apple at reportaproblem.apple.com. We can’t issue App Store refunds ourselves.
  • Restoring: Plus belongs to your Apple ID. On a new phone signed in to the same Apple ID, tap Restore on the subscription screen to get it back.
  • We may change what the Free plan and Plus include. We won’t take away something you’ve already paid for during the current period.

Your songs

Songs are made with AI. Lyrics are drafted by Anthropic’s Claude and the music by Google’s Lyria, from what you enter. Because they are generated, a song may occasionally be inaccurate, odd, or not to your taste. The content boundaries you set are applied, but we can’t promise every song will respect them perfectly. Tell us in the app when one misses.

You keep whatever rights you have in what you enter. You give us permission to use it to make, deliver and improve your songs, as described in the privacy policy.

We give you a personal, non-exclusive licence to listen to, keep and share the songs made for you for non-commercial purposes. Don’t sell them, use them in advertising, or claim you wrote or performed them.

We keep your songs for as long as the privacy policy says: a year for songs made on the Free plan, and for Plus songs as long as you subscribe, then up to a year after. Download or share any you want to keep longer.

Using it well

Please don’t:

  • Enter anything that is unlawful, hateful, harassing or sexually explicit, or that targets another person.
  • Enter someone else’s private information, or content you don’t have the right to use.
  • Try to make songs that imitate a real artist or reproduce existing lyrics.
  • Reverse-engineer, overload, scrape or get around the limits of the service.

We may limit or stop song generation for anyone who does.

An alarm, not a guarantee

DayTone uses Apple’s alarm system and keeps a backup sound on your phone so an alarm still rings when a song isn’t ready. Even so, an alarm can fail to ring or fail to wake you, for example if your phone is off, out of battery, muted by a system setting, or if iOS changes how alarms behave.

Don’t rely on DayTone alone where missing an alarm could cause harm, such as for medication, safety-critical work or travel you can’t miss.

Our app and content

DayTone, including its design, software, classic sounds and brand, belongs to PantaWorks and its licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, under these terms and Apple’s usage rules. Apart from the songs licence above, these terms don’t give you any other rights in DayTone.

If you send us feedback or ideas, we may use them without owing you anything.

Apple and other services

These terms are between you and PantaWorks, not Apple. Apple has no obligation to provide maintenance or support for DayTone. If the app fails to meet a warranty that applies by law, you can tell Apple and Apple may refund the purchase price, if any; beyond that, Apple has no warranty obligation. Apple is not responsible for claims about DayTone, including product liability, legal compliance or intellectual property claims; we are, to the extent these terms say. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You confirm that you are not in a country under a US government embargo or on a US list of prohibited or restricted parties.

DayTone relies on other services, such as Apple’s alarm and purchase systems and the AI providers named in the privacy policy. Their availability is outside our control.

Warranties and liability

DayTone is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including that the app will be uninterrupted, error-free or fit for a particular purpose.

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, including missed appointments or lost opportunities, and our total liability to you is limited to the amount you paid for DayTone in the 12 months before the claim.

Nothing in these terms limits rights you have under consumer law that can’t be waived.

Ending the agreement

You can stop using DayTone at any time, and delete your account and data in Settings › Delete account & data. Cancel any subscription separately through Apple. We may suspend or end access if you break these terms.

Changes

We may update these terms. The date at the top shows the latest version, and we’ll tell you in the app about significant changes. Continuing to use DayTone after a change means you accept it.

Governing law
